How to fight AT&T in small claims court and WIN

PublikDemand has a great blog post describing in detail how to sue AT&T over data throttling. Then readwriteweb added to this post by adding there own article diving deeper into what you need to do. Both are very descriptive pieces that we have added to our Steps to Sue section with everything you need from Beginning, Filing, Notification and Proving your case. I want to thank them both for putting such a detailed posting up it will help a lot of people!

Lets use these step and file as many lawsuits as possible to sue AT&T. and then please come back and post you stories in our comments section so we can help others!

Unlimited Means Unlimited

It has come to the point that AT&Ts greed has reached new heights. By throwing a bait and switch on its users of their smart phone unlimited plan it is not only abhorrent but illegal as well. AT&T reeled you in with the iPhone and amazing unlimited data plans to go along with it. The flourished with the monopoly of the iPhone. Now everyone has a smart phone and are using more data then they planned (Not the users fault) and are now reneging on the contracts that we signed.

If you are in the top 5% of users AT&T says they can slow your data speeds intentionally. Now if you go over 3 Gigs of your UNLIMITED data you will be reduced. BUT if you pay for more you will not be slowed down. They use a clause in their contract that is used for people intentionally trying to bring down their network as a reason why they can slow your speeds down when it is straight forward that if you pay more the data usage is fine.

AT&T is using BS and legal wrangling to make it so that their users can't sue them in Class Action Law Suit so one person, Matt Spaccarelli, went to small claims court and won a settlement. No AT&T is challenging that in court as well. I and may other like me think this is amazing BS as so this blog is coming to life.

Our goal is to create a blog / site where people can get information on how to take AT&T to small claims court and sue them for their illegal practices. We will give you the resources, stories of others and different laws/ tactics that others have used. Over the next weeks and months we hope to have as many people join this blog, discuss it and win against AT&T. We believe AT&T will try to then change their agreements so that we can not do this either but the law will not allow that.

So lets use our rights as consumers and sue the living hell out of this company and hope that AT&T will see they cannot screw their customers or maybe (most doubtful) reverse their tactics.
